1. Booking & tenancy


As soon as the rental offer from Villa Flamingo Dream has been accepted, it is binding.

Renting a residential property is not associated with travel insurance, flight tickets or the like. The lease includes the property as advertised on the Internet at www.flamingodreamcapecoral.com. The correct number of people must be specified when booking. In the event of overcrowding, occupancy without consultation or a deviation in the number of people as specified in the rental application, the landlord or the property management on site has the right to refuse excess people or to demand an extra charge for them. The undersigned tenant is liable and acts for all listed fellow travelers. The booking, special requests or other agreements are only valid with written confirmation.

2. Housing law


Only persons listed in the rental agreement have the right to live in the holiday home. If people not registered in the holiday home and staying overnight are found, the landlord or the property management company is entitled to terminate the rental agreement without notice.

Additional people, up to a maximum of 6 residents, can be reported to the landlord at any time, so that a recalculation can be made.

Pets are not allowed in the holiday home or on the property. Smoking is not allowed anywhere in the house. Smoking is allowed on the terrace. Only plastic cups or plastic dishes are allowed at the pool. The fragile dishes may only be used in the dining area outside or in the holiday home. Since the pool area has a screen, ball games are only permitted with inflatable balls. Hard balls can cause serious damage to the screen. If these rules are not observed, the tenant is liable for any resulting damage.

3. Obligations of the tenant


The tenant undertakes to protect the Vacation Villa Flamingo Dream he has rented from damage, to use it with care and to return it with all keys and accessories at the end of the rental period. The tenant is obliged to keep the rental property clean and has to leave it in a proper condition on the day of departure. In the event of improper compliance, a possible surcharge can be billed separately and, if necessary, offset against the deposit. Damaged living spaces or objects must be reported to the property management immediately and paid for; the amount may be offset against the deposit. Any damage and defects found on arrival must be reported to the property management on site within 24 hours, otherwise the tenant is liable for the damage. In the event of malfunctions or problems, the tenant undertakes to notify the property management on site immediately so that they know and can provide help if necessary. The holiday home may not be sublet in whole or in part.

No objects, only toilet paper, may be thrown into the sewage system. In the presence of non-swimmers, especially children, the tenant is obliged to supervise. The tenant must grant pool and garden service staff free access to the terrace and garden at all times.

4. Rental costs


The rental price includes the costs for final cleaning, electricity, water and gas for the grill. The rental price is for 2 adults and 2 children under 6 years. Each additional person up to a maximum of 6 people pays an additional $ 35.00 / night. Children under 6 are free. A subsequent reduction in the contractually agreed fellow travelers (number of people who will be living in the rental property) or a travel interruption does not lead to a reduction in the originally agreed rental price.

If the agreed down payment has not been received within 7 days of booking confirmation and / or invoicing for the Flamingo Dream holiday home, the landlord reserves the right to rent out the rented property to someone else without further notice and without being in any way liable to the tenant.

In the event of cancellation or withdrawal, the amount already paid will not be refunded.

5. Liability


The landlord is not liable for direct or indirect property damage or physical damage to the tenant or to third parties, nor for accidents suffered or caused by a technical defect, negligence or improper use in and around the rental property or its furnishings. The landlord expressly refers to the duty of supervision and liability of parents or adults for their accompanying children or minors. This applies to the entire area of the rental property and especially to the pool area. There is a safety barrier for the pool area for children - please ask for it at check-in. The landlord is not a tour operator, so that in no case does the travel law apply.

6. Booking conditions

With the signature of the tenant, he accepts these booking conditions for himself and for all fellow travelers. Florida law applies to disputes arising from this contract. The place of jurisdiction is Bonita Springs, Florida.
